VISTO estas actuaciones relacionadas con la Carta Intención Marco de Cooperación Científica, Tecnológica y Académica, suscrita en idiomas Español e Inglés entre la VAAL TRIANGLE TECHNIKON, (SUDÁFRICA) y la UNIVERSIDAD NACIONAL DE SALTA, (ARGENTINA); y
CONSIDERANDO:
QUE por la misma, ambas partes se comprometen a fomentar la cooperación académica de investigación científica, académica, tecnológica y cultural, como así también a favorecer la transferencia de conocimientos, el perfeccionamiento y la capacitación de docentes, graduados, investigadores y alumnos de ambas partes.
QUE ASESORIA JURÍDICA a fs. 12 en su Dictamen Nº 7113, expresa que no tiene objeción legal que formular.
QUE a fs. 27 la COMISIÓN DE INTERPRETACIÓN Y REGLAMENTO del CONSEJO SUPERIOR emite Despacho Nº 95/03 de fecha 10 de diciembre de 2003, en el cual aconseja la aprobación de la citada Carta Intención Marco.
Por ello y atento a lo dispuesto por la resolución CS-Nº 084/02,
EL RECTOR DE LA UNIVERSIDAD NACIONAL DE SALTA
R E S U E L V E:
ARTICULO 1º.- Aprobar la Carta Intención Marco de Cooperación Científica, Tecnológica y Académica, suscrita en idiomas Español e Inglés, entre la VAAL TRIANGLE TECHNIKON, (SUDÁFRICA) y la UNIVERSIDAD NACIONAL DE SALTA, (ARGENTINA), que como ANEXOS I y II forman parte integrante de la presente resolución.
ARTICULO 2º.- Publíquese y comuníquese a: Rectorado, Secretarías del Consejo Superior, Académica y Administrativa, Coordinación de Relaciones Internacionales, Facultades, Sedes, Dirección General de Administración y notifíquese al interesado. Cumplido siga a la COORDINACIÓN DE RELACIONES INTERNACIONALES, para su toma de razón y demás efectos. Oportunamente Archívese.

CARTA INTENCION MARCO DE COOPERACIÓN CIENTÍFICA,
TECNOLÓGICA y ACADÉMICA ENTRE LA VAAL TRIANGLE TECHNIKON, SUDÁFRICA y LA UNIVERDIDAD NACIONAL DE SALTA, ARGENTINA
Entre la Universidad Nacional de Salta. representada en este acto por su Rector, Dr. Víctor Omar Viera. y la Universidad de Vaal Triangle Technikon, Vanderbijlpark. Gauteng. Sudáfrica representada por su Vice Chancellor & Rector Prof. Aubrey T. Mokadi. Según Resolución Rectoral N° 408/2003, se acuerda formalizar la siguiente carta intención de cooperación y colaboración mutua.
ARTICULO 1º: Las partes se comprometen a fomentar la cooperación académica de investigación científica, académica, tecnológica y cultural entre ambas instituciones, como así también a favorecer la transferencia de conocimientos, el perfeccionamiento y la capacitación de docentes, graduados, investigadores y alumnos de ambas partes.
ARTICULO 2º: Las partes establecerán Proyectos Específicos de colaboración, buscando apoyo en sus necesidades y el intercambio científico y cultural entre las diferentes áreas de ambas instituciones. Cada Proyecto Específico, considerado como parte integrante de este Convenio General, establecerá sus objetivos, la forma de llevarlos a la práctica, el calendario, los costos, los responsables.
ARTICULO 3º: Ambas partes estudiaran las formas concretas de establecer Proyectos Específicos en beneficio reciproco dentro de los siguientes campos:
Intercambio de Profesores e Investigadores que puedan participar como expositores o dar apoyo 1nstltucional por medio de asesorías o que estén interesados en recibir formación complementaria.
Intercambio de Alumnos y Egresados, los que serán favorecidos para que puedan realizar estudios complementarios de especialización. así como estadías de Investigación o perfeccionamiento.
Colaboración para la superación académica fomentando el asesoramiento directo entre ambas instituciones para intercambiar experiencias y recursos docentes, promover tareas de investigación y de extensión conjuntos dentro de aquellas áreas en las cuales ambas partes tengan un interés manifiesto.
Intercambio de material científico, académico, tecnológico, producido en formas de libros, publicaciones periódicas y documentos por miembros de ambas instituciones, para impulsar la integración institucional.
Compartir el uso de las bibliotecas de acuerdo con las modalidades de cada institución.
La Fundación Chase (TCEF) participará en cl bienestar y orientación de los participantes a los proyectos de ambas instituciones. Las empresas que colaboran con ambas instituciones serán bien venidas por participar.
ARTICULO 4º: los resultados que se logren a través de los trabajos y acciones realizadas en virtud del presente convenio serán de propiedad común. Podrán ser utilizados, publicados o difundidos conjunta o separadamente de acuerdo a lo convenido en cada caso. con indicación de origen o autoría.
ARTICULO 5°: en el caso de generarse ingresos como consecuencia de este convenio, los mismos se repartirán de acuerdo a lo pactado en cada Proyecto Específico y deberán incorporarse a cada una de las partes según sus respectivas normas.
ARTICULO 6°: este convenio estará vigente desde la fecha en que este firmado por ambas partes y tendrá una validez mínima de 4 (cuatro) años renovables automáticamente. El mismo podrá ser rescindido por cualquiera de las partes mediante una comunicación escrita enviada con 6 (seis) meses de anticipación, con el compromiso de completar las acciones iniciales. Este modo de conclusión contractual no importará indemnización para ninguna de las partes.
ARTICULO 7°: los firmantes fijan su domicilio legal en Universidad de Salta. Buenos Aires 177, Salta 4400. Pcia. de Salta, Argentina y la Universidad de Vaal Triangle Technikon, en Private Bag X201. Vanderbijlpark. Gauteng. 1900. Sudáfrica. Ambos se someten expresamente a jurisdicción de los Tribunales Federales de la ciudad de Salta.
En prueba de conformidad se firman dos ejemplares del presente convenio en la ciudad de Salta, Pcia. de Salta, a los 18 días del mes de noviembre de dos mil tres.

OF SALTA, SALTA CITY, PROVINCE OF SALTA. ARGENTINA.
Between fue National University of Salta, Salta City, Province of Salta. Argentina, represented in this document by their Rector, Dr. Víctor Omar Viera. and the Vaal Triangle Technikon. Vanderbijlpark, Gauteng. South Africa, represented by their Vice Chancellor and Rector Prof. Aubrey T. Mokadl in terms of Rectoral Resolution Nº 408/2003, agree to formalize the following agreement for collaboration to their mutual benefit.
ARTICLE 1º: The parties undertake the responsibility to promote academic cooperation to encourage the exchange of technology in Scientific investigation, Technology, Research and Cultural expansion, as well as support the exchange of knowledge, the training and betterment of Faculty members, scholars, Investigators and students to the benefit of both
ARTlCLE 2º: Both institutions will establish specific collaboration projects, seeking support in accordance to their individual needs, as well as the scientific exchange in different areas of Interest. Each specific project will be considered as an integral part of this letter of Agreement will establish the objective,. a practical manner in which same can be implemented, set deadline dates, costs, and responsible parties to support the development of the exchange program.
ARTICLE 3°: Both Institutions will. witth the support and collaboration of the Chase Foundation (TCEF) will analyse the means to concrete Specific Projects with a reciprocal benefit within the following areas:
Exchange of Professors and investigators who may participate as Lecturers or offer institutional support through assessment, or whom are interested In the exchange of complimentary information.
Exchange of students and graduate students, who may be permitted to realize complimentary specific training. development of knowledge or training. or studies in different areas, or whom may wish to obtain additional information.
Collaboration in the academic development. to foment direct assessment between both institutions to exchange experiences and staff resources, promote investigational tasks and combined efforts in areas where both institutions manifest their interest.
Exchange of Scientific, academic, and technological material in the form of textbooks, periodical publications and documents produced by members of both institutions in order to support and give impulse to institutional integration.
Share the use of Academic material / libraries in accordance with the corresponding established morality of each institution.
The Chase Foundation (TCEF) will provide support to both Institutions in the development of projects between institutions and will actively participate in the international exchange programs,.The Chase Foundation (TCEF) will participate in the planning, well being, orientation and development of academic programs between both institutions. Commerce and industry collaboration with both institutions will be welcomed.
ARTICLE 4°: The results that are obtained through the international exchange of Technology and their related activities will be honoured as common property between both institutions as indicated in this agreement. They may be used, published, or transmitted, separately or by both institutions in accordance with the agreed and corresponding written consent In each case with an indication of the origin or author as declared necessary.
ARTICLE 5º: In the case that income is generated as a consequence of this agreemen,. the same shall be equally distributed in accordance with a separate written agreement in each case, and should be made available to each of the institutions concerned In accordance witb the established written norms.
ARTICLE 6º: This agreement will take effect from the date of signing of each institution and will have a minimum validity of 4 (four) years which will be renewable automatically. The agreement. may be revoked by either of the institutions through a valid and written communication sent with 6 (six) months anticipation, with the condition of completion of existing programs. This manner of contractual conclusion will not result In indemnification from either of the institutions involved.
ARTICLE 7°: The undersigned declare their legal domicile as the Universidad Nacional de Salta. Buenos Aires 177. 4400 Provincia de Salta, Argentina, and the Vaal Triangle Technikon, Private Bag X201. Vanderbijlpark, Gauteng. 1900. South Africa. Both agree that they expressly agree to the Jurisdiction of the Federal Tribunal of the City of Salta. Argentina.
As proof of conformity, two copies of the present agreement have been signed in the City of Salta. Salta Province, on the day November 18 of the year two thousand and three.
